A small quote from Irving Kayton's monumental _Patent Practice_, 5th edition, volume 5, page 21-20: Although utility patents are granted a term of 17 years, and... expire 17 years from the date of issuance, 35 USC section 156... provides for an extension of this term under narrow circumstances of delay due to regulatory review by the Food and Drug Administration or the US Dept of Agriculture... Patented human drug products, medical devices, food additives and color additives subject to regulatory review for their safety and efficacy had long suffered from want of the full 17 years of statutory protection otherwise provided by 35 USC 154. Invariably the required testing period prior to FDA approvals for commercial sale and use invaded the 17 year period--often for a period of several years; sometimes for most of the statutory period. Enacted September 24, 1984, 35 USC 156 extends the term (life) of a patent up to a maximum of five years to offset lost time in the patent's life due to FDA review. To get this extension, one applies to the patent office, who may grant such an extension, based on the amount of time the FDA held back use during testing, but "no matter how much patent time was sacrificed by the FDA... the remaining time under the patent after extension is not permitted to total more than 14 years." >>...in the >>last couple of days, both the NY Times and the Boston Globe have carried >>stories about how some patents (and I'm not sure why some and not others) >>have been extended to 20 years, because of GATT efforts to make patents more >>uniform throughout the world. I believe that applies to all utility patents, vs. design patents, plant patents, etc. That's a different story. A moving target... >>In particular, regarding patents on drugs, >>which up until now in the US have expired 17 years after issuance, >> "Effective June 8, the patents will extend to 20 years from the date the >>manufacturers filed for a patent." -- Boston Globe, 26 May '95, p. 10, I think this applies more than just drug patents... And it may not really be much of an extension at all, since the normal delay from patent application to patent issuance, ie the delay in the patent office, is on the order of 1-3 years, AFTER which the 17 year patent term begins. So this new way of making the patent term date from the date of filing, vs. the patent issue date, may slice a few years off the new 20 year term. One extreme case of patent office delay is that of the patent for FM radio, invented by Armstrong. The patent issued 27 years after Armstrong applied for it, as I recall, to his widow, after his suicide, out of despair, partly because of the delay in the patent office, which may have had something to do with RCA... Joe, everybody, Since our postings a few days ago on selecting the best approach for stress calculations on geodesic structures, I've been going through Kenner's books and the patents collected in Inventions fairly closely. Bucky himself must have considered these questions as well, which does not bode well for finding a ready answer. I hope these thoughts are of some use. If we define geodesic domes as omnitrianguled space frames which exhibit a characteristic three-way tension grid, then geodesic domes evidently defeat traditional post-and-beam methods of calculating stresses -- like bumblebees which fly when they theoretically shouldn't be able to, geodesic domes bear loads and withstand pressures they theoretically can't handle. I say evidently because I can't site a specific proof offhand. (Does anybody know of one?) Despite this apparent large, gaping hole in their logic, traditional engineering seems uninterested in the problem. Bucky called that reprehensible. The elasticity multiplication effect that Kenner describes in Geodesic Math, and that you just posted on, may only apply to tensegrity structures which contract evenly under stress. We're back to the question of whether all geodesic domes are tensegrities by definition, and, again, I really believe it has to do with how you define your terms. A tensegrity structure is described by Kenner in the back of 'Guided Tour' as a continuous tension network with compressional stiffeners, independent of outside anchorage, stable in any position. In that book Kenner also describes the counterintuitive properties of the Tensegrity -- it looks insubstantial but it practically indestructible. Tensegrities not only react as whole system to local stresses, but amazingly they react by contracting evenly. Geodesic structures, in the wide variety of shapes and sizes they're built in, are plainly not identical to pure tensegrities. Most geodesic structures are anchored to a foundation; some are double- layered; some are struct networks covered by a separate sheath and others have stressed skins. Safe to say that not all of them would be stable in any position. Most would not contract evenly under local stress. Pure Tensegrities are complete integral systems in the form of spheres or tetrahedrons, and geodesic structures are commonly truncated to make them practical. When Fuller writes that all geodesic domes are tensegrities, he might have more accurately said that to some unknown degree all geodesic domes rely on a tensegrity-like triangulated tension grid for their strength and stability. In the course of discussing something else, I asked Bill Perk last week -- he said pure tensegrities and geodesic domes such as Bucky's old residence in Carbondale exist on a sort of continuum. On the pure end of the continuum, compressive components are very widely separated and neutralized, if you will, by the number and force of the tension components. To use Bucky's words, they exist in a sea of tension. On the impure end of the continuum the compressive components are not-so-separated, not-so-neutralized, and exert more significant force. It's also interesting to note that Fuller's 1954 Geodesic Dome patent contains no discussion of tension vs. compression. Language in the patent summary seems to imply that it is the dome's ability to evenly distribute compressive loads that is unique and new, a more modest and (from a traditional engineering standpoint) more plausible claim, as opposed to a dome's ability to reduce compressive forces relative to tensile forces. All of this is just talk, of course. It still puzzles me that no one has gone about proving or disproving these theories experimentally. Again, I welcome any corrections or amplifications -- I don't mean to present myself as anything but just another poor schmoe trying to sort all of this out. AS THE MILLENNIUM TURNS by Evan Ravitz (Still 5 years ahead of its time.) HEALING THE SICK ENVIRONMENTAL MOVEMENT First the good news: environmental education, one of the key values and strategies of the environmental movement, is a huge success. More evidence of this is an April 19th poll by the American Enterprise Institute showing that more than twice as many Americans -53%- say we should sacrifice economic growth for the environment than the reverse -23%. (I think this a false choice, but that's another story.) And 79% consider themselves environmentalists. Yet, Robert Kennedy Jr., standing in front of the Capitol, where his uncles passed environmental legislation, said this Earth Day: "Today I can tell you what the largest threat to our environment is, and it's right behind me -the U.S. Congress. They're literally dismantling 25 years of environmental progress." Representative democracy has become an oxymoron. David Brower, Executive Director of The Sierra Club in its heyday and founder of Friends of the Earth and Earth Island Institute, gave his diagnosis of the sick environmental movement: "Turf-tending, ego, smugness, procedural barricades to progress, a new love of access (to the corridors of power) and a new fear of boldness...It afflicts the entire movement." Doesn't this sound like a description of politics and government? It is: with a few exceptions, like the confrontational Greenpeace, the environmental movement is playing the political game designed by their opponents: the giant corporations and their representatives, lobbyists and bureaucrats. It's a losing game: more and more of environmentalists' money is going to lawyers, lobbyists and endless paper. Do you pay taxes? Those taxes are used by your government to defeat the environmental -and peace and justice- movements. And you probably contribute more to taxes than to environmental organizations. So your net economic effect on the environment and the future is negative. CU math prof and Ancient Forest Rescue leader Marty Walter says he's done the calculation. You could join the tax resistance movement. Or you could be putting some of your money and time into our prescription: giving more legislative power to citizens. The polls show the environment will come out ahead. Here is our proposal, homegrown in Boulder and gaining prominence in democratic circles on the Internet. It is the only concrete plan based on existing initiative laws in effect in 23 states and DC (including Colorado), using simple technology proven with National Science Foundation grant GI-37183 in 1974. It can work locally, by state, and nationally. We should pass initiatives that: 1) Give citizens the option of voting by telephone.* People will soon prefer it as the see that it is more secure, far less expensive. more environmental and far easier than existing systems. It is more secure because most votes are now counted by computer, but the counting programs are proprietary and secret from everyone including election officials. Ours will be public. Additionally, after voting, the computer will tell you, for instance, that you were the 5000th to vote, and that you can confirm your vote on line 5000 in the morning paper. No present voting system gives you this bottom-line assurance of accuracy. 2) Seriously reduce the signatures required to get initiatives on the ballot. Once elections are 10-20 times more affordable, as the NSF- funded trials for the San Jose Unified School District showed, we can start encouraging more citizen-initiated legislation. Initiatives are now so hard to do that only large organizations that can pay petitioners get on the ballot. 3) Allow voting quarterly, as the Swiss do, or monthly, to accommodate the backlog of ideas that never before could make it to the ballot or thru legislative bodies. May the best ideas win! Citizens will make mistakes, but the mistakes will be our responsibility, and we'll revisit decisions until we get them right. When politicians make mistakes, they cover up, and throw good money after bad. For folks afraid that the majority will trample the rights of minorities, let's examine Colorado Amendment Two, narrowly passed by initiative in 1992. Two says that gay-rights laws are forbidden. But all the Colorado courts ruled that Two violates the US Constitution's 14th Amendment, and so it's never gone into effect -it's now before the US Supremes. Two violates the 14th's "equal protection" clause, which says everyone may lobby for their needs and wants. Citizen democracy does not mean repealing the Constitution! How will our proposal affect mistakes like Two? First, more people will vote, because of the convenience, and because we'll have more choices: voting will count for more. Second, when a mistake is made, opponents (gay people and friends in this case) will easily put reversing legislation on the ballot the next time. The gays talked about it but realized they realistically couldn't both get it on the ballot, and still have the money and energy to run a good campaign. Thirdly, part of the reason it passed was the confusing wording: voting yes meant no gay- rights laws. An initiative should be passed prohibiting this kind of confusion. The environment is starting to die the death of 1000 cuts (see the Warning to Humanity issued last year by 104 Nobel and 1576 other laureates), while the environmental movement is racing to stay in one place, applying bandaids. In the money battle for media and representatives, between polluting corporations and environmentalists, who is winning? It is time to change the game. The educational battle is largely won. Now we must give more power to the people. *We were the first in the world to do this, putting it on the November '93 Boulder city ballot. Underfunded amateurs, we were defeated (59%- 41%) by a hostile City Council and Daily Camera. We were supported by the Colorado Daily, The Sierra Club Indian Peaks Group, Colorado Common Cause, COPIRG and the Center for People with Disabilities. This load is resisted by the 5 or 6 members converging at this vertex. These members are in compression. The structure bolts togather and the fabric panels are tensed over this frame work. I have built 16', 24' and 32' dia. domes (by adding to my strut inventory). Currently, I am working on refining the panel system. I must say that it works well in that it has withstood 40-70 mph wind gusts without coming apart, and has shown itself waterproof. The refinements are primarily to further seal the panel overlaps which cause problems in high winds and pass-thru of tensile elements. It is a work in progress. The structures are very strong and simple to construct. I (220 lbs) climb them and there is no apparrent deflection at the vertices. I saw him at Texas A&M Univ. He was a guest speaker in a guest speakers series. I remember the way he energised the hall. The thing I that stands out most clearly in my mind, when recalling the occasion, was his exhorting the audience to not to idolize him but to focus the principles of which he talked (eg ephemerization, synergy, etal) I've read articles describing him as an ego driven, self promoter. However, this was not how he came across at that lecture, as he "thought out loud" nor though his books which I later read. Of course, people change though their lives; probably he did too. ========================================================================= Date: Mon, 5 Jun 1995 08:40:19 PDT Reply-To: List for the discussion of Buckminster Fuller's works Sender: List for the discussion of Buckminster Fuller's works From: Joe Moore Subject: SELF-CONTAINED Does anyone know of any articles in either yachting or motorhomeing magazines describing all the latest tech features (energy systems, sewage handling, water supply systems, communication systems, etc). Much of this globe was inspired by Buck's dymaxion map so I'm listing several Bucky resources as well as NOAA, USGS, and many good cartography and geography locations. I'm looking for the more map oriented stuff as well as some general reference. Anybody else out there with some good ideas about inclusions? T'would be nice if the "self-contained" details included space and water heating and air-conditioning, with some windows for passive solar heat, and a high-thermal mass warmstore above, with a DHW heat exchanger and a ceiling fan that is activated by a thermostat to bring down heat in the Winter, and an earth-coupled coolstore below, combined with a cistern, to provide Summer cooling and rainwater storage from the roof, as well as condensation storage from the warmstore/sewage-treatment ceiling pond. And a vertical-axis windmill for electricity, located at the apex of the dome. Over 80% of the undeveloped land in Pennsylvania is unsuitable for a conventional septic system, and water and electric supplies tend to be expensive, here in the boonies. Telephones may be less of a problem, given the genuine telephone interfaces with radio links made for rural use by InterDigital Communications, among others. >On another note, does anyone know of any PORTABLE dome shells being built out >of materials that will not ROT, BURN, or serve as FOOD for bugs? The army defines "portable" as "having handles for lifting" :-) >Surely somebody somewhere must be working on these things! (I hope.) Moore R. Buckminster Fuller found a way to translate information from curved to flat surfaces and vice versa in such a way that there was minimal distortion of the data. His technique works for polygons whose edges are equal, such as a tetra- hedron, octahedron, cube, icosahedron, vector equilibrium, dodecahedron, etc. He preferred the icosahedron because it has the greatest number of equalateral triangles. It makes no difference whether the data is on the outside or inside surface. For further information see: ---------------------------------------------------------------------------- "U. S. Watkins" Subject: Bucky Meeting I saw/heard Bucky speak at Friends University in Wichita, Kansas. I'm not sure but it was early 1970's. Maybe 1972. His topic was the Global Village but as with normal Bucky discourse that wasn't the focus, just the jumping off point and a thread that he wove back and forth with all his normal themes. As I remember it, he gave a rather long speech and when he was given a standing ovation he came out and spoke for another 20 or 30 minutes. I had read several of his books so was familiar with most of his topics. In a speaking environment his style of repetition with variation seemed even more pronounced than in his books. I remember that he spoke at some length about the limitations of the standard educational approach to teaching geometry, i.e., plane geometry. He also related his early childhood problems with eyesight and how that influenced his reliance on large patterns. His emphasis was that anyone could understand the ideas that he was working with and that anyone was capable of developing their own similar body of knowledge. The global village theme was easy to trace through his regular themes. The utopia or oblivion theme, a design revolution as more appropriate response to the world's problems than political solutions, plus a lot of information about technological trends. He also tied in the global village theme by relating many of his projects in all parts of the world over many years. As a big Bucky fan I was even more impressed after hearing him speak. It was also apparent that the audience was kept in tune with a lengthy and involved speech. **************************************************************************** * COOPERATION>COMPETITION * est.enuf.4.all * *--------------------------------------------------------------------------* * David F. Included was mention that July 15-16 there is a Centenial celebration of R.B.Fuller in San Diego. Most of the events will be in Balboa park. The seminars cost $, but for free there will be many showings of some video and kids can play with model building materials. In the Automotive Museum (which costs a few dollars) there will be a DYMAXION CAR! I don't have any more details with me here right now. ------------------------------------------------------------------------------- O Martin | "That is not dead which can eternal lie, And martino@gomez.jpl.nasa.gov | with strange aeons even death may die. -Lovecraft ========================================================================= Date: Fri, 9 Jun 1995 00:15:56 -0400 Reply-To: AMKALENAK Sender: List for the discussion of Buckminster Fuller's works From: AMKALENAK Organization: America Online, Inc. I'd also like to hear if anyone has trouble viewing the page on their browser. On a related note, people may be interested to know that the company that owns my Webspace, Volant Turnpike, is offering a free megabyte of webspace to anyone who wants it, as long as it isn't used for commercial purposes. My whole web site takes up only about 50k at the moment - if all us Bucky fans were to get a megabyte each, that would give us a hefty archive space for free.. something to think about. You can apply for your free megabyte of space at: http://turnpike.net/index.html regards, Richard (not affiliated with Volant Turnpike in any way - just very, very happy with the service they provide..) *----------http://metro.turnpike.net/G/GoatBoy/index.html----------* Hippies: never trust anyone over 30 Punks: never trust a hippie ========================================================================= Date: Fri, 9 Jun 1995 08:24:56 PDT Reply-To: List for the discussion of Buckminster Fuller's works Sender: List for the discussion of Buckminster Fuller's works From: Joe Moore Subject: REVISED BFVI! Have recently done CAD versions of 270, 360, 480 and 810 strut spheres. However, I have not yet convinced myself that I've constructed the models in the 'best' way to reduce the number of different components. For instance, the 360 strut one needs 6 pieces. If anyone has tips, please let me know. Can someone point me to instructions on how to best post some of my work on the Internet. Also I need instructions on all the steps for instance does the file need to be uuencoded then attached to a message? Where does the message get sent etc., etc.. To Joe S. Moore: Please accept my thanks for your continued efforts in getting the Bucky info out to everyone. There are a lot of us out here quietly benefitting from your efforts. Suggestion: Include a version date in the subject area of the Virtual Institute postings so that we can easily see which is the latest. In general it is good to have the first part of file names pertaining to related info the same so related information appears together alphabetically in a directory list. My geometry models are done using spherical geometry (3-D arcs at radius 1) starting with a unit of symmetry such as the spherical icosahedron face or the spherical alternate triangle (formed by joining the centroids of face triangles). Then I can rotate and copy the base unit of symmetry around to form a complete sphere if I want. Straight lines between appropriate crossing points of the spherical arcs would be the tensegrity struts I refer to. The number required for a complete sphere are the numbers I mentioned (270, 360, 480 and 810 strut spheres). -- ______________________________________________________________________________ Ken G.
