A lot of what you and perhaps LLR fight under as Britannical is,
IMO, owing to the Romans (who in turn did a lot of synthesizing).
"Pax Americana" only makes this obvious -- Latin, duh.

The UK imperial style had much to do with building on models
of past empires, as emulated through architecture and the
institutions within.

Washington DC was built (in a swamp) when the Eurocivs were
still considered the only viable templates (and not just the
English were into public buildings modeled after Greco-Roman
temples e.g. the Supreme Court building, with "juris" and
"legis" roots floating everywhere in the vicinity).

What's been happening since is a continued rise in literacy,
but literacy has a shape to it, i.e. is not just a generic
blob.  In what +directions+ does our literacy evolve?

This is where open source comes in, and all those Russian
and Chinese kids, busily downloading Linux source code and
mastering the C/C++ innards within (knowing full well their
counterparts in the USA, Finland, South Africa and India
are doing the same).

Whereas a corporation in the East India tradition is found
on boilerplate "Inc." language, crafted and understood by
fine-print lawyers, the large organizations of the future
are more likely to operate on the basis of business rules
spelled out in "man pages", with enforcement of contracts,
authentication, resource management, in the hands of Java
beans.  To design a corporation will mean sitting down with
database designers, website designers, coders of other
descriptions -- but less so lawyers.

Lawyers and politicians know how to "legislate" but maybe
not how to code.  For this reason, design science heralds a
different "look and feel" in the 21st century than we've
seen in the 20th.

I long-ago envisioned LAW as open source code which anyone
(human or corporate) could download, inspect, compile and run
to predetermine legal outcomes. The COURT being simply an
Input/Output device that feed the facts to the LAW Computer.
LAWYERS are turned into programmers who encode (and often
debug the logical inconsistencies) of Legislative DESIGNERS
responsive to user (consumer) demand for better applications.
A blend of computer science, ethics, law, and market dynamics.

Did you miss the heading "Open Source" ???  Any kid with a computer
could potentially download the source and hack a fix for global-local
socio-legal injustice by out-competing the status-quo big-business
proprietary-access secret-deals-in-back-rooms legal-BS OS. A Global
Social-Legal-Political Operating System for Humanity evolving blindly
through open access competition for solutions. What works sells, and
what sells rules. Power shifts to the thoughtful-creative individual
(or design team) from the control-and-conquer bureaucratic parasites.

I don't think talking about corporations as machines is the same
as talking about automating to the point where humans no longer
have roles.  We'll get different theater, certainly, but in my
view the internet and open source is an invitation to billions
of would-be design science studios (small, efficient) to get in
on the action.  There's no shortage of work that needs doing.

In the general systems theory view, a corporation is indeed an
inamimate object (a box), not a pseudo-human as defined in legal
fiction (with human rights plus a giant's powers to hire and
fire, pull political strings and so forth).  Humans are not
conceived, as in the "ship" metaphor, to be "inside" the
corporation.  Rather, humans connect to the corporation via
the various job title interfaces which the corporation defines
(e.g. CEO, CFO, webmaster, inventory manager -- whatever cast).
Every interface comes with its "man pages" re how to operate the
machinery in that capacity.  Many resources are shared, with some
data protected.  You've got the intranet, internet and firewall
between.

These corporations may be "virtual" in the sense that the humans
patching in to operate it are mostly remote.  Some servers in
the UK might be part of the corporate network, with others in
New York or Portland.  You can have intranets which traverse
such distances (the intranet/internet distinction isn't
primarily geographic).

I think you can see the difference right here in this open source
thread.  Engineers aren't the ones most interested in artificially
inhibiting technology in order to create scarcity in service of
business plans inherited from the dark ages.  Moneymakers with
a hypocritical approach to alleviating the world's poverty can't,
in the final analysis, cough up a coherent ethics in support of
their institutionalized selfishness (hence the crumbling and crashing
sounds we hear all around us -- cite: Twilight of the World's Power
Structures (Critical Path)).

Yes, useful link.

Getting folks excited about Fly's Eye Domes etc. requires
bridging from the known.  We need segues.  The manufactured
homes industry, plus the travel trailer/RV industry is a
source of prototypes (my RV -> BizMo transition didn't
happen the way I'd hoped, but still could).

"The state of Texas is well on its way to meeting the
nation's most ambitious state goal for the production of
electricity from renewable energy sources == wind, solar,
biomass, and geothermal == and doing so seven years ahead
of schedule, the American Wind Energy Association (AWEA)
said today.

    "The Lone Star State's smashing success in attracting
renewable energy-based power plants could have national
implications.  While the Clinton Administration has been
sharply criticized by some Republicans in Congress for
energy policies that favor renewables, Texas, AWEA said,
is making it clear that renewable energy technologies ==
especially wind energy == are ready for prime time.

    "'In 1999, the Texas legislature approved, and Gov.
George W. Bush signed into law, a requirement that the
state's utilities install or contract to buy power from
2,000 megawatts of new renewable energy generating
capacity by Jan. 1, 2009,' AWEA executive director Randall
Swisher explained.  'Last week, the chair of the Public
Utility Commission of Texas said that goal may be reached
by Jan. 1, 2002, fully seven years ahead of time and just
two and a half years after the law was passed.

    "'A combination of factors have come together in Texas
to make this happen: a heck of a wind resource, a drop in
the costs of wind energy technology, a well-crafted
renewable energy requirement, and non-discriminatory
electricity transmission rules. Texas provides a textbook
example of what could be achieved nationwide with these
'fabulous four.'"

    "(2,000 MW is equal to about 3% of Texas' generating
capacity, and is enough to serve roughly 400,000 Texas
households with 1 million people.)

     "In recent weeks, Texas utilities have made headlines
with the announcement of plans for some of the world's
largest wind farms:

      "Reliant Energy, based in Houston, said Aug. 24 that
it will buy power from the 208-MW King Mountain Wind
Ranch, to be built next year south of Odessa, Tex.  The
plant will consist of 160 wind turbines, each with a
generating capacity of 1.3 MW.

     "Dallas-based TXU Electric & Gas announced July 19
that it would purchase electricity from a 160-MW wind
farm, also scheduled for construction next year, that is
to be developed by the nation's largest wind energy
producer, FPL Energy LLC.

     "The Texas law which has led to this burst of
activity, involving some $2 billion in new business
investment, is a 'renewables portfolio standard (RPS),'
which requires that a certain amount of electricity be
obtained from renewable energy sources.  Utilities are
free to decide which energy resource they want to use, and
they typically issue solicitations and allow bidders to
compete to supply energy.

     "A national RPS would work much the same way.  The
Clinton Administration has proposed to require that 7.5%
of the nation's electricity be generated from renewables
(not including hydro) by the year 2010, but critics have
charged that the goal is unrealistic and will be too
expensive.  In contrast to these assertions, the Texas RPS
is being fulfilled with wind energy capacity that competes
well with the cost of new fossil fuel generation.

      "Some have asked whether an RPS is needed, given
wind's increasing economic competitiveness, but Swisher
said it is:  'The RPS has provided the extra incentive
that utilities need to seriously look at wind and other
renewables.  Now that they have, it's obvious that they
like what they see.

     "'The overwhelming success of the Texas RPS shows
that the wind energy industry is ready and able to deliver
on the long-pursued promise of clean, inexhaustible,
affordable energy from renewable resources. The wind
energy industry is proof that economic growth and
preservation of the environment can go hand in hand."

When James Delong testified before Congress in April, he told
legislators the uncomfortable truth about antitrust law and the
economics of software.

"My conclusion is simple," said the then-general counsel for
the National Legal Center for the Public Interest. "A system of
thought that was not adequate for dealing with the old economy,
based on heavy machinery and physical investment, provides a
poor foundation for dealing with a new economy based on
intellectual property. Extrapolating these inadequate doctrines
to the new concept will create a system of enforcement by whim,
not by law, [and] the consequences will be destructive."

Simple, indeed. Today's statutes can't handle the information
economy. In Silicon Valley parlance, the law " doesn't get it."
That is why, said DeLong and others, the most important issue
in law today is redefining legal principles—literally through
trial and error—so that they can be applied realistically to IT.

The great unknown is what effect these coming legal battles,
especially the efforts to apply antitrust law to IT, will have
on corporate enterprises.

Antitrust law is designed to protect consumers, so being able
to prove anti-competitive practices is important for enterprise
customers as well. Further, innovation and the law are
inextricably linked, so changing the law will change how
products are made, sold and used.

The "Napster effect" also will surely change how companies
share information—depending on the way the courts rule on how
the technology can and can't be used. Fisher noted that, left
as is, the Napster phenomenon would have a negative effect on
the enterprise.

"Distributing something on the Internet or on a shared network
means it's extremely efficient for lots of people to see it,"
Fisher said. "But if they can see it without paying for it,
eventually there's less incentive to even develop something or
innovate."

The bottom line is that these issues will take years to sort out.
The sluggish pace of the Microsoft trial is a harbinger of what's
to come. Relative to software, the law changes slowly.

traveling through, and asked him about a video.  Doug said
that although theaters do routinely video performances, the
archival copies are not made public because of union and/or
actors guild issues.  I wasn't clear on precisely what those
issues were, but I got the idea there wouldn't be a video
unless some institution (e.g. public TV) purchased the rights
and staged a play specifically for the purpose of broadcasting
(or I suppose a company like Viacom could purchase rights
specifically for the purpose of making a video version
available through Blockbuster type outlets).  At this time,
I know of no such plans.

If he does, why couldn't he and a few friends go somewhere (out of site) and
videotape it.

However, I guess if his contract/agreements with the actors guilds or
whomever, definitely forbids this, the point is moot.

I think the argument could be made that a video at this time
might undercut audience attendence, even though many watching
the video would not be potential ticket-buyers (on the other
hand, who knows how many cities this play could eventually
visit).  It wouldn't surprise me if the playwrite had no
immediate desire to undercut the profitability of his work
in the eyes of theater owners, who will contract for shows
only if it looks like audiences will be forthcoming.

I think the many positive reviews and enthusiastic audience
response sets the stage for the video negotiations to occur,
but I wouldn't expect to see such a video reach the public
until well after the play itself has folded its tent.  Likewise,
I wouldn't expect either the playwrite or the actor to do an
amateur version and try to market it independently.  Their
interests would be better served by negotiating with a large
volume producer/distributor, who would be expecting to recoup
against a much larger market, and could therefore compensate
for their input far more handsomely.

Personally speaking, I'm quite happy to see a Bucky-related
commercial venture succeeding.  It's notoriously difficult to
have any financial success in the theater world, plus its a
difficult test of integrity to capture something of the man
himself, i.e. this goes to the core of being "Bucky-related"
(an appropriate venue in this case, as Bucky had some overlap
with the theater world while living -- starting with the
famous incident at Harvard which led to his expulsion).

For me, this happiness is akin to my pleasure at seeing the
business world figure out ways to profit even while retaining
their commitment to open source -- companies like Red Hat are
doing quite well, because of their value-added contributions
to a difficult technology, in this case Linux. People need
all the help they can get, and will gladly compensate for
services rendered in this regard.  Likewise, I respect Sun
for making Java a free download, even providing IDE tools
(e.g. the NetBeans product, Forte).  This hasn't undercut
Sun's profitability.  On the contrary, creating a user-base
for a language is a prerequisite for achieving other goals
(putting 'Synergetics' on the web is entirely analogous --
I recall using this Java analogy when talking to the Estate
about it).

We need to explode the myth that getting mixed up with the
design science thread is going to mean shipwreck in a financial
sense.  There's nothing inherently impossible about running a
successful business that pays the bills and rewards its people,
even while making advances in directions long dreamed of by
Bucky & Co.

I probably has nothing to do with the playright and everything to do with
professional unions.

Our church puts on a musical/play the last week in December.  Its called the
'Boars Head and Yule Log Festival'.  We're one of less than 10 places in the
US that does this.  Just shy of 200 cast members another 50 in the crew, 6
performances with about 600 people attending each.  Everything is volunteer
and the tickets are free: except for the orchestra.  They are union.  They
are 2/3 of the budget and we cannot sell anything (or even give it away)
that has any recording of the music.

If we do we will have to pay royalties to the union and that will
dramatically increase the cost.  I even went to the local public library to
try and use their local access TV studio equipment and put the performance
on public access TV.  No can do.

We've had 3 conductors in 25 years and the master score is full of notes and
annotations.  We can't even have it reprinted without violating copyright
laws.

We would like to make a CD or video tapes, but the royalties (which are
apparently fixed) would far outweigh any potential revenue we might realize.


A church in Cincinatti Ohio is in their 6th decade of performances.  They
were lucky enough to get their orchestra to resign from the union for the
week of their shows.
